TERMS AND CONDITIONS Terms of Use, Acknowledgment, and Liability Disclaimer Issued by Aging Solutions LLC | Effective Date: [08/10/2026] | Version: [2.0]
Purpose. These Terms and Conditions (“Terms”) govern the Trinity EMS Card (“Card”), the Trinity Connect daily check-in service (“Trinity Connect”), and the secure online customer portal (“Portal”) (together, the “Services”) provided by Aging Solutions LLC (“Aging Solutions,” “we,” “us,” or “our”). The Services are intended solely as informational and convenience resources. They are not a substitute for professional medical advice, diagnosis, or treatment, and they are not a substitute for calling 911 or another emergency service in the event of an emergency. By requesting, purchasing, enrolling in, accessing, or using any of the Services, the customer (the “Member”) and, where applicable, the person enrolling on the Member’s behalf, agree to these Terms.
1. The Services.
- Trinity EMS Card. A card and corresponding Portal record containing the Member’s self-reported, basic health information, intended to assist emergency medical personnel and other responders in quickly understanding that information.
- Trinity Connect. A scheduled check-in service delivered by [text message and/or telephone call]. If the Member does not respond to a check-in, Aging Solutions will make additional attempts to reach the Member and may then contact the Member’s designated emergency contacts. Where Aging Solutions reasonably believes it is warranted, it may request a welfare check or contact 911 or local emergency services on the Member’s behalf.
- Portal. A secure website through which the Member, and any person the Member has authorized, may view and update information provided to Aging Solutions.
2. Not an Emergency, Medical, or Monitoring Service. The Services are not a medical alert system, a personal emergency response system, or a continuous monitoring service. Trinity Connect checks in only at scheduled times and does not detect falls, monitor vital signs, or track location. Aging Solutions is not a medical provider and does not diagnose, treat, or give medical advice. In any emergency, the Member or anyone present should call 911 immediately.
3. Accuracy and Updates. Aging Solutions does not independently verify, and does not guarantee the accuracy, completeness, or timeliness of, any information provided for the Services, including information recorded on the Card or in the Portal. The Member, or the person who completed the intake information on the Member’s behalf, is solely responsible for ensuring that all information, including medications, allergies, medical conditions, physicians, emergency contacts, telephone numbers, and addresses, is current, accurate, and updated promptly as circumstances change.
4. Member Responsibilities for Trinity Connect. The Member agrees to (a) keep the telephone used for check-ins charged, powered on, and able to receive calls or text messages during scheduled check-in times; (b) notify Aging Solutions in advance of travel, hospitalization, or any other period during which the Member will be unable to respond, so that check-ins may be paused; and (c) ensure that designated emergency contacts are reachable and have agreed to serve in that role. Failure to do so may result in missed check-ins, unnecessary escalation to emergency contacts, or requests for emergency services, for which Aging Solutions is not responsible.
5. Authority to Enroll and Provide Contact Information. If you enroll yourself, you represent and warrant that you are the subscriber or customary user of each telephone number and email address you provide, and that each emergency contact you list has agreed to be contacted by Aging Solutions. If you enroll another person, you represent and warrant that (a) you have the Member’s express consent, or the legal authority to act on the Member’s behalf (such as a valid power of attorney or guardianship), to enroll the Member, provide the Member’s personal and health information, and accept these Terms on the Member’s behalf; and (b) you have the consent of the subscriber or customary user of each telephone number and email address you provide. You agree to provide proof of such consent or authority upon request, and you agree that these Terms are binding on both you and the Member.
6. Consent to Calls, Text Messages, and Email. By enrolling, the Member, and the person enrolling on the Member’s behalf, consent to receive telephone calls, text messages, and emails from Aging Solutions at the numbers and addresses provided, including check-ins, alerts, reminders, Portal sign-in codes, and service notices, and agree that Aging Solutions may contact designated emergency contacts as described in these Terms. Message frequency varies; Trinity Connect members should expect at least one check-in per day. Message and data rates may apply. Reply STOP to opt out of text messages or HELP for assistance. Opting out of text messages will stop Trinity Connect check-ins delivered by text. Emails from Aging Solutions contain links and sign-in codes, not health information.
7. Portal Access and Account Security. The Portal is accessed using a one-time code sent to the email address on file. Anyone with access to that email account may be able to access the Portal, and the Member is responsible for keeping that email account secure. The Member is responsible for all changes made through the Portal by the Member or by any person the Member has authorized, and should notify Aging Solutions promptly of any suspected unauthorized access. Users must sign out after using a shared device and may not attempt to access another person’s information or interfere with the Portal’s operation.
8. Use by Responders and Third Parties. Emergency responders, medical providers, and other third parties should treat the Card and any information shared through Trinity Connect as a supplemental reference only, and should rely on their own professional judgment, training, and standard protocols in all situations. Aging Solutions is not responsible for how any third party, including emergency responders, emergency dispatch services, hospitals, caregivers, emergency contacts, family members, or others, accesses, interprets, or acts (or fails to act) upon information provided through the Services.
9. No Guarantee of Response, Delivery, or Access. Carrying the Card does not guarantee that any emergency responder or other person will locate, access, read, or rely upon it. Trinity Connect depends on telephone, wireless, text messaging, and internet networks, electrical power, third-party service providers, and other systems outside Aging Solutions’ control. Aging Solutions does not guarantee that any check-in, message, alert, or call will be sent, delivered, received, or answered, or that any emergency contact or emergency service will respond within any particular time or at all.
10. Assumption of Risk. By requesting, purchasing, enrolling in, carrying, or using any of the Services, the Member, and, where applicable, the person enrolling on the Member’s behalf, acknowledge that the Services are provided as a convenience only and voluntarily assume all risk associated with their use, non-use, interruption, or failure, the loss of the Card, and the accuracy of any information provided.
11. No Liability. To the fullest extent permitted by applicable law, Aging Solutions, its owners, officers, employees, and agents shall not be liable for any claim, loss, injury, damage, or outcome, whether direct, indirect, incidental, or consequential, arising from or related to the issuance, content, use, misuse, non-use, loss, interruption, failure, or unauthorized disclosure of the Card or any of the Services, including any missed, delayed, or undelivered check-in, alert, or call. This limitation applies to claims based on negligence to the maximum extent permitted by law. Where liability cannot be fully excluded, Aging Solutions’ total liability shall not exceed the amount paid by or on behalf of the Member for the Services in the twelve (12) months preceding the claim. Nothing in this section limits liability for gross negligence, willful misconduct, or any liability that cannot lawfully be limited or waived under applicable law.
12. Indemnification. The Member, and, where applicable, the purchaser, guardian, or other person enrolling on the Member’s behalf, agree to indemnify and hold harmless Aging Solutions from any third-party claim, loss, or expense (including reasonable attorneys’ fees) arising out of or related to that person’s use or misuse of the Services or breach of these Terms, including any inaccurate information or unauthorized enrollment, except to the extent caused by Aging Solutions’ own gross negligence or willful misconduct.
13. No Medical or Provider Relationship. Use of the Services does not create a patient-provider, physician-patient, or any other professional or fiduciary relationship between the Member and Aging Solutions.
14. Loss, Theft, or Misuse. Aging Solutions is not liable for any consequence arising from the loss, theft, damage, or unauthorized use of the Card, or from unauthorized access to the Portal resulting from the compromise of the Member’s email account or device.
15. Privacy and Data Handling. The Services involve sensitive personal and health-related information. Aging Solutions stores Portal information with service providers that have agreed to safeguard health information, and handles information collected through the Services consistent with its Privacy Policy [and, where applicable, its Notice of Privacy Practices], available at [link] or upon request. The Member authorizes Aging Solutions to disclose information provided through the Services to emergency responders, emergency dispatch services, hospitals, designated emergency contacts, and persons the Member has authorized, as reasonably necessary to provide the Services. Aging Solutions does not sell personal or health information. Once the Card is issued, the Member assumes responsibility for its physical storage, display, and disclosure.
16. Fees, Renewal, and Cancellation. Fees for the Services are as stated at the time of purchase or enrollment. [Trinity EMS Card: set up fee $29.99 / monthly fee $7.99 / annual fee $79.99.] [Trinity Connect: monthly $14.99 – $49.99.] Subscriptions renew automatically and are charged to the payment method on file until cancelled. The Member may cancel at any time by contacting Aging Solutions at 844-888-5309 or info@agingsolutionsnw.com; cancellation takes effect at the end of the current billing period. [Refund policy.] Aging Solutions will provide at least [30] days’ notice of any price change.
17. Suspension and Termination. The Member may stop using the Services at any time. Aging Solutions may suspend or terminate the Services for non-payment, misuse, breach of these Terms, or discontinuation of the Services, with reasonable notice where practicable. Upon termination, Trinity Connect check-ins will cease, and information will be retained or deleted consistent with the Privacy Policy and applicable law.
18. Governing Law; Jurisdiction. These Terms are governed by the laws of the State of Washington (Aging Solutions’ state of formation and principal place of business), without regard to conflict-of-law principles, regardless of the state in which the Services are purchased, issued, mailed, or used. Any dispute arising out of or relating to the Services or these Terms shall be brought exclusively in the state or federal courts located in Spokane County, Washington, and the Member consents to personal jurisdiction there. If the mandatory consumer-protection laws of the Member’s home state cannot lawfully be waived or superseded by this choice of law, this section applies only to the extent those laws permit.
19. Severability. If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
20. Changes to These Terms. Aging Solutions may update these Terms from time to time. For the Card, the version in effect when a Card is issued governs that Card unless a replacement Card or written notice states otherwise. For Trinity Connect and the Portal, Aging Solutions will provide notice of material changes by email or through the Portal at least [30] days before they take effect, and continued use of the Services after that date constitutes acceptance of the updated Terms.
