Trinity Connect Terms and Conditions

1. Agreement

These Terms of Service (“Terms”) are an agreement between Aging Solutions Northwest [legal entity name, e.g., LLC] (“we,” “us,” “our”) and the person who subscribes to Trinity Connect (“you” or “Subscriber”).

If you enroll on behalf of another person (the “Participant”), such as a parent or loved one, you confirm that you have their permission or legal authority to do so. You agree to these Terms on your own behalf and on theirs. “You” includes the Participant where it makes sense.

By completing enrollment, submitting the Trinity Connect preference form, or using the service, you agree to these Terms. If you do not agree, do not use Trinity Connect.

2. The Service

Trinity Connect is a daily wellness check-in service. We contact the Participant by text message (and, on some plans, by phone) to confirm they are okay. If they do not respond, we follow the escalation steps in Section 4.

PlanMonthly priceIncludes
Basic$14.99Daily text check-ins, 7 days a week
Extended$24.99Daily text check-ins plus verbal (phone) check-ins [describe frequency]
Premium$49.99Daily text check-ins, verbal check-ins and medication reminders

Your check-in time, emergency contacts and other preferences are set using the Trinity Connect preference form. Prices do not include applicable taxes. We may offer other plans or change features as described in Section 10.

3. Not an Emergency or Medical Service

Trinity Connect is a wellness check-in service. It is not a medical alert system, medical monitoring service, or substitute for emergency care. In a medical emergency, call 911 directly.

You understand and agree that:

  • We do not provide continuous or real-time monitoring. Check-ins happen at scheduled times only.
  • We do not provide medical advice, diagnosis, or treatment. Our staff are not medical professionals.
  • Medication reminders are a convenience only. You remain responsible for taking medications as prescribed. We do not dispense, track, or verify medication use.
  • We cannot guarantee how quickly emergency responders, emergency contacts, or anyone else will respond once notified.

4. Check-Ins and Escalation

Each day at the scheduled time, the Participant receives an “Are you okay?” message. Replying as instructed confirms they are okay.

If we do not receive a response:

  1. We send a follow-up attempt after 1.5 hours.
  2. If there is still no response after 3 hours, we contact the emergency contacts on file, in the order listed.
  3. If we cannot confirm the Participant’s safety through them, we may call 911 or local emergency services and request a welfare check at the Participant’s address on file.

Authorization. You authorize us to contact your emergency contacts and emergency services and to share the information in Section 8 with them when we believe it may help protect the Participant’s safety. We decide in good faith whether and when to escalate.

Costs. You are responsible for any costs from an emergency response, such as ambulance fees or damage from forced entry, whether or not an emergency existed.

Service interruptions. Check-ins depend on cell networks, phone carriers, internet and other systems outside our control. Messages may be delayed or not delivered. We are not responsible for failures caused by these systems, power outages, or events beyond our reasonable control.

5. Your Responsibilities

To help Trinity Connect work as intended, you agree to:

  • Give accurate, complete information on the preference form, and keep it up to date.
  • Keep the Participant’s phone charged, turned on, and able to receive texts and calls from our number.
  • Tell us promptly about changes to phone numbers, address, emergency contacts, or medications (Premium).
  • Tell us in advance about travel, hospital stays, or other times check-ins should be paused. We are not responsible for escalations caused by missed notice.
  • Not use the service for any unlawful purpose or to harass anyone.

Emergency contacts. You confirm that each emergency contact you list has agreed to be contacted by us, including by call or text, and to share their contact details with us. You are responsible for telling them what may be expected of them.

6. Consent to Texts and Calls

By enrolling, you give express consent for Aging Solutions Northwest to send recurring automated text messages and make automated or prerecorded calls to the phone numbers you provide, for check-ins, reminders, escalation and account notices. Consent is not a condition of any other purchase.

  • Message frequency: about 1-2 messages per day, plus follow-ups when needed.
  • Message and data rates may apply, based on your mobile plan.
  • Carriers are not liable for delayed or undelivered messages.

We do not sell or share phone numbers for others’ marketing.

7. Fees, Billing and Cancellation

Automatic monthly renewal. Your plan renews automatically each month until you cancel. By enrolling, you authorize us to charge your payment method on file the monthly plan price, plus applicable taxes, on the enrollment date each month.

Failed payments. If a payment fails, we will notify you. We may pause or end the service if payment is not received within 30 days. We will tell you before check-ins stop.

Cancellation. You may cancel anytime by calling (844) 888-5309 or emailing info@agingsolutionsnw.com. Cancellation takes effect at the end of the current billing month, and check-ins continue until then.

Refunds. Monthly fees are non-refundable, including for partial months.

Price changes. We will give you at least 30 days’ written notice before a price increase. You may cancel before it takes effect.

8. Privacy and Health Information

We collect the information needed to run Trinity Connect: names, phone numbers, address, emergency contacts, check-in responses and, for Premium, medication reminder details.

How we use and share it. We use this information only to provide the service, communicate with you, and handle billing. We share it only:

  • with emergency contacts and emergency responders, as described in Section 4;
  • with service providers who help us operate (such as text messaging and payment processors), under confidentiality obligations; and
  • when required by law.

We do not sell your personal or health information.

Consent to health data. Some information, such as medications, may be consumer health data under Washington’s My Health My Data Act. By submitting it, you consent to our collecting and sharing it for the purposes above. You may withdraw consent or ask us to delete your data by contacting us, though this may end the service.

Our full Privacy Policy is at Privacy Policy – Aging Solutions and is part of these Terms.

9. Disclaimers and Limitation of Liability

No guarantee. Trinity Connect is provided “as is” and “as available.” To the fullest extent allowed by law, we make no warranties, express or implied, including that the service will be uninterrupted, error-free, or will prevent injury, illness, or death.

Limitation of liability. To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, or consequential damages, or for personal injury, death, or property loss arising from a missed, delayed, or failed check-in, reminder, or escalation. Our total liability for any claim related to the service will not exceed the fees you paid us in the 1 month before the claim arose.

Indemnification. You agree to indemnify and hold harmless Aging Solutions Northwest and its owners, employees and contractors from claims arising from inaccurate information you provide, your breach of these Terms, or claims by a Participant or emergency contact you enrolled.

10. General Terms

Changes to these Terms or the service. We may update these Terms or change service features. We will give you at least 30 days’ notice of material changes by email or text. Continuing to use the service after that means you accept the changes.

Termination by us. We may suspend or end the service for non-payment, misuse, or breach of these Terms, or if we stop offering Trinity Connect. We will give reasonable notice when possible and refund any prepaid fees for service not provided.

Governing law and disputes. These Terms are governed by the laws of the State of Washington. Before filing a claim, you agree to contact us and try to resolve it informally for 30 days. Any legal action will be brought in the state or federal courts in Spokane County, Washington.

Other terms. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, the preference form and the Privacy Policy are the entire agreement about Trinity Connect. You may not transfer this agreement without our consent.
